Changes in Residence Status


Applicable to foreign nationals who have a valid residence status and wish to obtain a different immigration status than the one they were authorized for, by submitting the application, documentation, and requirements established in the regulations, with which they can prove any of the circumstances provided for in each of the seven types of change of residence status.

  • Application

    Format to request immigration stay procedure, filled out electronically through the website, printed and with the autograph signature of the petitioner.

    Important:

    In the case of minors under 18 years of age, the application form must be signed by the mother, father or whoever exercises parental authority, guardianship or curatorship.

  • Requirements

    General Requirement:

    The documents (applications) for the procedures must be submitted in original only, and their annexes, in copy. If the interested party requires an acknowledgement of receipt, she/he must attach a copy for that purpose. (Article 15 A section I of the Administrative Procedure Federal Act).

    For the seven types of changes in residence status, the general requirement is:

    • Passport, identity and travel document, or official document presented to obtain the status of residence to which they are entitled. Original and copy.

    Note: If you have renewed or changed your passport, identity and travel document, or official document, you may present it, as long as it is valid and current.


    I. Change TO PERMANENT RESIDENT BY FAMILY UNIT

    Applicable to foreign nationals who hold visitor status in any of its forms, temporary resident or temporary student resident, who wish to reside in the national territory on a permanent basis and can prove family unity with a Mexican or foreign national with permanent residence, in accordance with the conditions and requirements to be presented.

    In addition to the application form and general requirements, you must submit:

    1. Temporary resident card, temporary student or visitor card, or valid and current FMM. . Original.
    2. Proof of payment of fees for the receipt and review of the change of status, in accordance with the Federal Law on Fees and other applicable legal provisions. Original and copy..
    3. Valid official identification of the Mexican person (passport, INE, professional license, military service card, consular registration, naturalization letter, and valid driver's license) or permanent residence card of the foreign person, proving the relationship. Original and copy.
    4. Prove family unity in accordance with the following:
    a) Be the parent of a Mexican or foreign national with permanent residence in Mexico: Birth certificate of the Mexican national or permanent resident. Original and copy..
    b) Be the child of a foreign national with permanent residence: Birth certificate, provided that the child is a girl, boy, or adolescent and is not married, or is under guardianship, conservatorship, or custody. Original and copy.
    c) Be the child of the spouse or common-law partner of a Mexican or foreign national with permanent residence, provided that you are a child or adolescent and are not married, or are under the guardianship, curatorship, or custody of the spouse or common-law partner:
    • Birth certificate of the minor and; Original and copy..
    • Marriage certificate or document proving the cohabitation of the father or mother with the Mexican or foreign person. Original and copy..
    d) Be a child or adolescent whose parental authority, guardianship, or conservatorship is held by a Mexican or foreign permanent resident: Document issued by the competent authority. Original and copy..
    e) Be the child of a Mexican person in accordance with subsection d), section I of the criteria (born abroad and not Mexican in accordance with Article 30 of the Political Constitution of the United Mexican States):
    • Letter of naturalization of the Mexican person. Original and copy..
    • Birth certificate of the foreign person. Original and copy..
    f) Be the sibling of a Mexican or foreign national with permanent residence: Birth certificates of both, provided that you are a child or adolescent and have not married, or a document proving that you are the legal representative of the Mexican or permanent resident. Original and copy..
    g) If you obtained temporary residence through marriage or cohabitation with a Mexican or foreign national with permanent residence:
    • Marriage certificate or document certifying cohabitation in accordance with civil law or equivalent issued by the competent authority of the foreigner's country of origin or residence. Original and copy..
    • Written statement under oath signed by the applicant and their spouse or common-law partner, indicating the marital address and the existence of the relationship during the two years prior to the application.

    i) Being the grandmother or grandfather of a Mexican national by birth:

    j) Be the daughter or son of a Mexican citizen by birth: Birth certificate of the applicant. Original and copy..
    k) Be the granddaughter or grandson of a Mexican citizen by birth:

    5. Proof of payment of fees for the receipt, review, and, where applicable, issuance of Permanent Residence, in accordance with the Federal Law on Fees and other applicable legal provisions. Original and copy.

    Important:

    • Foreign public documents, with the exception of the passport or identity and travel document, must be apostilled or legalized and, where appropriate, accompanied by a translation into Spanish prepared by officially recognized experts as appropriate.

    • The foreign person must appear personally before the immigration authority, to provide the photograph, signature and fingerprint data for the basic format and, where appropriate, for the issuance of the immigration document.


    II. Change TO TEMPORARY RESIDENTBy FAMILY UNIT

    Applicable to foreign nationals with visitor or temporary student resident status who wish to reside in Mexico and can prove a connection to a Mexican or foreign national with temporary or permanent residence.

    In addition to the application form and general requirements, you must submit:

    1. FMM, visitor card, or temporary student resident card. Original.
    2. Proof of payment of fees for the receipt and review of the change of status, in accordance with the Federal Law on Fees and other applicable legal provisions. Original and copy.
    3. Valid official identification of the Mexican person (passport, IFE/INE, professional license, military service card, consular registration, naturalization letter, and valid driver's license) or valid temporary or permanent resident card. Original and copy.
    4. Demonstrate a link in accordance with the following:
    a) Be the parent of a foreign national with temporary residence or temporary student residence: Birth certificate of the temporary resident or temporary student resident. Original and copy.
    b) Be the spouse of a Mexican or foreign national with temporary residence, temporary student residence, or permanent residence: Marriage certificate. Original and copy.
    c) To be a common-law partner of a Mexican or a foreigner with temporary residence, temporary residence or permanent residence: Document that proves concubinage in accordance with civil legislation or document that proves a figure equivalent to the concubinage granted by the competent authority of the country of origin or residence of the foreigner, in which it is stated that the interested party and the Mexican or temporary resident, Temporary resident, student or permanent resident have lived together constantly and permanently for the corresponding period.     d) Be the child of a temporary resident foreigner or temporary resident student: Birth certificate. As long as he or she is a child or adolescent and has not married, or is under his or her guardianship, guardianship or custody. Original and copy.
    e) Be the child of the spouse or common-law partner of a temporary resident or temporary resident student. As long as the child or adolescent is not married, or is under guardianship, guardianship or custody of the spouse or common-law partner:

    • Marriage certificate or document proving the cohabitation of the father or mother with the foreign national. Original and copy.

    f) Be a child or adolescent, whose parental authority, guardianship or guardianship is in charge of a temporary resident foreigner or temporary resident student: Document issued by the competent authority. Original and copy.
    5. Proof of payment of fees for the receipt, review, and, if applicable, issuance of the Temporary Resident immigration document, in accordance with the authorized duration. Original and copy.

    III. Change TO VISITOR FOR HUMANITARIAN REASONS

    Applicable to foreign nationals with visitor status without permission to engage in paid activities; visitors with permission to engage in paid activities; visitors for adoption purposes; regional visitors; or cross-border workers who meet any of the requirements for changing to visitor status on humanitarian reasons.

    In addition to the application form and general requirements, you must submit:

    1. FMM or valid and current visitor card. Original.
    2. Present the documents that prove any of the following assumptions:
    a) Being an offended person, victim or witness of a crime committed in national territory: Public documentary issued by the competent authority from which the quality of offended person, victim or witness of a serious crime in national territory is derived or; Original and copy.
    b) Being a political asylum applicant: Evidence of receipt of the application by the SRE. Original and copy.
    c) Being a person applying for refugee status: Certificate of application issued by COMAR. Original and copy.
    d) Being a person requesting the determination of statelessness: Proof of the initiation of the procedure issued by the immigration authority. Original and copy.
    e) Being an unaccompanied girl, boy or adolescent: Letterhead of the consular representation of their country of origin or residence. Original and copy.
    f) For humanitarian reasons, you must present one of the following documents:
    • Document issued by a public or government authority or institution stating the reasons that justify the permanence of the foreign person due to risk to their health, safety or life or; Original and copy.
    • Document issued by the public institution that has a immediate relative of the foreign person in its custody, indicating the need for the latter to grant authorization to provide medical or psychological assistance, or intervention for recognition or recovery of the corpse, or; Original and copy.
    • Medical certificate issued by a health institution stating the serious state of health of a direct relative and documents proving kinship; Original and copy.

    Explanatory note for change to visitor status on humanitarian grounds:

    They are exempt from the payment of fees for the issuance of immigration documents in accordance with Article 16 of the Federal Law on Fees.


    Important:

    • The foreign person must appear personally before the immigration authority, to provide the photograph, signature and fingerprint data for the basic format and, where appropriate, for the issuance of the immigration document.


    IV. Change FROM VISITOR FOR HUMANITARIAN REASONS to TEMPORARY RESIDENT

    Applicable to foreign nationals who hold visitor status for humanitarian reasons and who, at the end of the process or for reasons that led to the authorization of said status, wish to reside in the country and meet one of the requirements for changing to temporary resident status.

    In addition to the application form and general requirements, you must submit:

    1. Proof of payment of fees for receiving and processing the application of the change of status, in accordance with the Federal Act on Fees and other applicable legal provisions. Original and copy.
    2. FMM or valid and current visitor card for humanitarian reasons. Original.
    3. Present the documents that prove any of the following assumptions:

    a) Job offer of a natural or legal person indicating the activity to be carried out, the required period of time (months or years), place of work and the data of the duly updated employer registration certificate. Original.

    b) Economic solvency, submit one of the following documents
    • Proof of investments or bank accounts with an average monthly balance equivalent to 20,000 days established in accordance with the Measurement and Update Unit (UMA) in force in the last 12 months or; Original and copy.
    • Documents that prove that you have a job or pension with monthly income free of liens equivalent to 400 days established in accordance with the UMA in force during the last 6 months. Original and copy.

      • UMA. Daily value in 2026: $117.31 MXN
      • In the event that the bank staments are issued electronically, you only need to submit a copy of them.
    c) Letter of invitation, submit the following documents:
    • Letter on letterhead from an organization, public or private institution of recognized probity inviting the foreign person to participate in an unpaid activity in the country that includes (full name of the applicant or interested party and nationality; name or corporate name of the organization; registration number and purpose of the organization or private institution; full address and contact details of the organization or institution; information about the activity or project to be carried out by the foreign person, which must be related to the purposes of the organization; duration or approximate date of termination of the activity and; Manifestation of joint and several liability for the maintenance of the foreigner during his stay in Mexico and his return to his country of origin or residence.     • Official identification with signature of the person signing the invitation letter. Copy.
    • Solvency to assume joint and several liability on the part of the private institution, which must be accredited with:
    • Proof of investments or bank accounts with an average monthly balance equivalent to 20,000 days established in accordance with the current UMA, during the last 12 months. Public, educational or research institutions belonging to the National Educational System or companies that transfer personnel to the parent company, affiliate or subsidiary in Mexico, do not require economic solvency. Original and copy.
    • In the event that the institution does not assume joint and several liability: Proof of investments or bank accounts of the foreign person with an average monthly balance equivalent to 10,000 days established in accordance with the UMA in force during the last 12 months; or documents that show that you have a job or pension with monthly income free of liens equivalent to 200 days established in accordance with the UMA in force during the last 6 months.     • Documents proving experience, ability, skills or knowledge to develop the activity for which it is invited. Original and copy.
    d) Real Estate in national territory: Public Deed granted before a Notary Public that certifies that the foreign person is the owner of real estate, with a value that exceeds 40 thousand days established in accordance with the current UMA. Original and copy.
    e) Investor, submit the following documents:
    • Deed or policy of the Mexican legal entity granted before a Notary Public, or document duly certified by the administrative body or competent official thereof, stating that the foreign person participates in the capital stock of said Mexican legal entity, and that the amount of the investment effectively disbursed for the participation of the foreign person in the Mexican legal entity exceeds twenty thousand days established in accordance with the current UMA, which may be accredited, including but not limited to, by means of a contract for the sale of shares or partnerships. , contract for the transfer of goods or rights in favor of the Mexican legal entity or document issued by the latter that proves the amount contributed by way of participation in the social capital and; Original and copy.
    • Document proving the ownership or ownership of movable property or fixed assets in favor of the foreign legal entity, used for economic or business purposes with a value that exceeds 20,000 days established in accordance with the current UMA. Original and copy.
    • Documentation that accredits the development of economic or business activities in national territory, which may be accredited, including but not limited to contracts, service orders, invoices, receipts, business plans, licenses, permits or proof issued by the IMSS indicating that the foreign person employs at least 5 workers.     4. Proof of payment of fees for receiving, processing the application and, if applicable, for issuance of the Temporary Resident immigration document with the requested and/or authorised period of validity, which may be from 1 to 4 years, in accordance with the Federal Law on Fees and other applicable legal provisions.     Important:
    • Foreign public documents, with the exception of the passport or identity and travel document, must be apostilled or legalized and, where appropriate, accompanied by a translation into Spanish prepared by officially recognized experts as appropriate.

    • The foreign person must appear personally before the immigration authority, to provide the photograph, signature and fingerprint data for the basic format and, where appropriate, for the issuance of the immigration document.

    V. Change FROM VISITOR FOR HUMANITARIAN REASONS to PERMANENT RESIDENT

    Applicable to foreign nationals with visitor status for humanitarian reasons who change to permanent resident status by obtaining recognition of refugee status or complementary protection from COMAR, political asylum from SRE, or determination of statelessness from the immigration authority.

    In addition to the application form and general requirements, you must submit:

    1. FMM or valid and current visitor card for humanitarian reasons. Original.
    2. Present the documents that prove any of the following assumptions:
    a) Having obtained recognition of refugee status or granting of complementary protection: Resolution of the COMAR in which their refugee status is recognized or complementary protection is granted. Original and copy.
    b) Have the granting of political asylum: resolution of the SRE that so determines. Original and copy.
    c) Having obtained the determination of statelessness: resolution of the immigration authority. Original and copy.

    Explanatory note for changing from visitor to permanent resident on humanitarian reasons:

    They are exempt from the payment of fees for the issuance of a immigration document in accordance with articles 50 of the Act on Refugees and Complementary Protection and 18-B of the Federal Act on Fees to those foreign nationals who have been authorised the condition of refugee and complementary protection and based on article 16 of the Federal Act on Fees to those foreign nationals who have been authorized the condition for reasons of political asylum, or for the determination of statelessness.

    VI. Change FROM STUDENT TEMPORARY RESIDENT TO TEMPORARY RESIDENT

    Applicable to holders of temporary student residence status who wish to change to temporary residence status because they meet one of the requirements listed above.

    In addition to the application form and general requirements, you must submit:

    1. Proof of payment of fees for receiving and rocessing the application of the change of status, in accordance with the Federal Act on Fees and other applicable legal provisions. Original and copy.
    2. Valid and current student temporary resident card. Original.
    3. Present the documents that prove any of the following assumptions:

    a) Job offer of a natural or legal person indicating the activity to be carried out, the required period of time (months or years), place of work and the data of the duly updated employer registration certificate. Original.

    b) Economic solvency, submit one of the following documents:
    • Proof of investments or bank accounts with an average monthly balance equivalent to 20,000 days established in accordance with the Measurement and Update Unit (UMA) in force in the last 12 months or; Original and copy.
    • Documents that prove that you have a job or pension with monthly income free of liens equivalent to 400 days established in accordance with the UMA in force during the last 6 months. Original and copy.
    c) Letter of invitation, submit the following documents::
    • Letter on letterhead from an organization, public or private institution of recognized probity that invites the foreign person to participate in some unpaid activity in the country that includes (full name of the applicant or interested party and nationality; name or business name of the organization ; registration number and purpose of the organization or private institution; full address and contact details of the organization or institution; information on the activity or project to be carried out by the foreign person, which must be related to the purposes of the organization; duration or approximate date of termination of the activity and; manifestation of joint and several responsibility for the maintenance of the foreign person during his stay in Mexico and his return to his country of origin or residence.     • Solvency to assume joint and several liability on the part of the private institution, which must be accredited with:
    • Proof of investments or bank accounts with an average monthly balance equivalent to 20,000 days established in accordance with the current UMA, during the last 12 months. Public, educational or research institutions belonging to the National Educational System or companies that transfer personnel to the parent company, affiliate or subsidiary in Mexico, do not require economic solvency.     • In the event that the institution does not assume joint and several liability: Proof of investments or bank accounts of the foreign person with an average monthly balance equivalent to 10,000 days established in accordance with the UMA in force during the last 12 months; or documents that show that you have a job or pension with monthly income free of liens equivalent to 200 days established in accordance with the UMA in force during the last 6 months.     • Documents proving experience, ability, skills or knowledge to develop the activity for which it is invited. Original and copy.
    d) Real Estate in national territory: Public Deed granted before a Notary Public that certifies that the foreign person is the owner of real estate, with a value that exceeds 40 thousand days established in accordance with the current UMA. Original and copy.
    e) Investor, submit the following documents:
    • Deed or policy of the Mexican legal entity granted before a Notary Public, or document duly certified by the administrative body or competent official thereof, stating that the foreign person participates in the capital stock of said Mexican legal entity, and that the amount of the investment effectively disbursed for the participation of the foreign person in the Mexican legal entity exceeds twenty thousand days established in accordance with the current UMA, which may be accredited, including but not limited to, by means of a contract for the sale of shares or partnerships. , contract for the transfer of goods or rights in favor of the Mexican legal entity or document issued by the latter that proves the amount contributed by way of participation in the social capital and; Original and copy.
    • Document proving the ownership or ownership of movable property or fixed assets in favor of the foreign legal entity, used for economic or business purposes with a value that exceeds 20,000 days established in accordance with the current UMA. Original and copy.
    • Documentation that accredits the development of economic or business activities in national territory, which may be accredited, including but not limited to contracts, service orders, invoices, receipts, business plans, licenses, permits or proof issued by the IMSS indicating that the foreign person employs at least 5 workers.     4. Proof of payment of fees for receiving, processing the application and, if applicable, for issuance of the Temporary Resident immigration document with the requested and/or authorised period of validity, which may be from 1 to 4 years, in accordance with the Federal Law on Fees and other applicable legal provisions.     Important:
    • Foreign public documents, with the exception of the passport or identity and travel document, must be apostilled or legalized and, where appropriate, accompanied by a translation into Spanish prepared by officially recognized experts as appropriate.
    • The foreign person must appear personally before the immigration authority, to provide the photograph, signature and fingerprint data for the basic format and, where appropriate, for the issuance of the immigration document.
    • Measurement and Update Unit (UMA). Daily value in 2026: $117.31 MXN

    VII. Change FROM TEMPORARY RESIDENT TO PERMANENT RESIDENT

    Applicable to foreign nationals with temporary resident status who wish to reside permanently in the national territory and can prove that they meet one of the requirements listed above.

    In addition to the application form and general requirements, you must submit:

    1. Valid and current temporary resident card. Original.
    2. Proof that proves the payments of fees for the receipt and study of the regularization request, in accordance with the Federal Rights Law and other applicable legal provisions. Original and copy.
    3. Provide proof of any of the assumptions mentioned below and present the corresponding document, as appropriate:
    a) By points system: documents that certify the indicators and minimum score required in accordance with the agreement published in the Official Gazette of the Federation. Original and copy.
    b) Pensioners or retirees present any of the following documents:
    • Proof of investments or bank accounts with an average monthly balance equivalent to 25,000 days established in accordance with the Measurement and Update Unit (UMA) in force during the last 12 months or; Original and copy.
    • Documents that prove that you have income or a monthly pension free of liens equivalent to 500 days established in accordance with the current UMA, during the last 6 months. Original and copy.
    • UMA. Daily value in 2026: $117.31 MXN
    • In the event that the bank staments are issued electronically, you only need to submit a copy of them.
    c) Four years have passed since you have held a temporary resident permit, with one of the following options:
    • Expressly indicate in the comments of the application form (part) that the change will be made in this way;
    4. Proof that proves the payments of fees for the reception, study and, where appropriate, the expedition that proves Permanent Residence, in accordance with the Federal Rights Law and other applicable legal provisions. Original and copy.

    Explanatory notes for changing from temporary to permanent resident:

    • The points system has not yet been implemented, so it is not possible to apply for permanent residency through this route.

    • Foreign nationals with temporary student residency cannot change to permanent residency.

    In the event of a positive decision, the payment must make this payment:

    Resident persons referred to in sections VI and VII of article 8 of the Federal Law of Rights, shall pay 50% of the fees that correspond to them in accordance with the aforementioned provisions, provided that they prove to the National Institute of Migration that their stay in the country is due to the preservation of the family unit, an offer of employment by a natural or legal person with current proof of registration as an employer, or by invitation of a public or private organization or institution established in the national territory to participate in activities without receipt of income in the national territory in accordance with the provisions of the Migration Law and its Regulations.


    Important:

    Payments can be made through the following means:

    1. At the Office for processing payments with Visa or MasterCard credit or debit cards
    2. Through a help sheet which must be filled out according to the following specifications:
    • Verify that it corresponds to the type of procedure requested.
    • Register exactly the full first and last names used to identify the foreign national in the application. (Regardless of the number of names and surnames).
    • In the case of minors, the payment must be registered with the names and surnames of the minors.
    The INM does not accept cash payments.

    It is suggested to thoroughly review the payment receipts issued by banking institutions, in order to ensure there are no errors in the person's identification data.

  • Follow-up Procedure
